These Sigma Comics, LLC Terms of Service are between you (“You”, “Your,” or “Merchant”) and Sigma Comics, LLC. Sigma Comics, LLC reserves the right, in its sole discretion, to change, modify, add, or remove all or part of these Terms, including but not limited to any term, applicable fee, policy, or guideline, at any time.
BY MAKING ANY PURCHASE ON THIS WEBSITE, YOU: (a) agree to be bound by these Terms and, (b) represent and warrant that, if You are an individual, You are 18 years old or older or, if you are an entity, that You are a corporation, partnership, or other legal entity duly formed (and incorporated if applicable) in good standing where required to do business with all legal authority and power to accept these Terms; (c) agree to provide true, accurate, current, and complete information in all billing and payment-related pages found on this website. You have the power and authority to enter into and perform under these Terms. IF YOU DO NOT ACCEPT AND AGREE TO THESE TERMS, DO NOT ORDER ANY PRODUCTS FROM THIS WEBSITE.
PAYMENT
You will pay all fees due according to the prices and terms applicable to you. Payment is due at time of placing your order on this website. If your payment is not received, you will not receive any items you ordered. We will contact you, at our discretion, for any required corrections, to facilitate your order. Sigma Comics, LLC may assign unpaid late balances to a collection agency for appropriate action. In the event legal action is necessary to collect on balances due, You agree to reimburse Sigma Comics, LLC for all expenses incurred to recover sums due, including attorneys’ fees and other legal expenses. You also agree to pay all outstanding charges, as well as taxes and fees assessed against You or Sigma Comics, LLC on the charges and all late payment, interest, or other fees as stated on your bill. Sigma Comics, LLC may modify its billing practices or late payment charges by providing You with prior written notice of the modification.
PRICE CHANGES
Sigma Comics, LLC may, upon notice required by applicable laws, at any time change the amount of or basis for determining any fee or charge or institute new fees or charges with respect to the Service.
TERMINATION BY SIGMA COMICS, LLC
Sigma Comics, LLC may terminate these Terms at any time upon notice to You. Notwithstanding anything to the contrary herein, Sigma Comics, LLC may also, but has no duty to, immediately suspend or terminate any active orders placed on this website, if Sigma Comics, LLC concludes, in its sole discretion, that You (a) have breached, violated, or acted inconsistently with the letter or spirit of these Terms, including any applicable law or regulation; (b) have provided false information as part of your Sign up and Account Information; (c) have failed to keep your Sign up and Account Information complete, true, and accurate; (d) fail to respond to any email communication sent to the email address listed in your Account Information; (e) are engaged in fraudulent or illegal activities or the sale of illegal or harmful goods or services; or (f) are engaged in activities or sales that may damage the rights or reputation of Sigma Comics, LLC or others (each “Termination for Cause”). Any Termination for Cause by Sigma Comics, LLC will take effect immediately, and You expressly agree that You will not have any opportunity to cure.
TERMINATION – LEGALITIES
In the event a ruling, regulation, or order issued by a judicial, legislative, or regulatory body causes Sigma Comics, LLC to believe that these Terms and/or the Service provided hereunder may be in conflict with such rules, regulations, and/or orders, Sigma Comics, LLC may suspend or terminate the Service, or terminate these Terms without liability.
RESPONSIBILITY FOR FEES
Should Sigma Comics, LLC suspend a portion, but not all, of your orders placed on this website due to a violation by You of any law, regulation, or policy, You shall remain liable for all applicable fees. Should Sigma Comics, LLC terminate your order(s), You are liable for the payment of all applicable fees applicable up to the date of termination, in addition to any early termination fees (if any).

CUSTOMER SUPPORT
At this time, Sigma Comics, LLC has very limited customer support capabilities, which are limited to fulfilling orders placed on this website, and following up on inquiries submitted on the form found on the CONTACT page. Sigma Comics, LLC reserves the right to establish limitations on the extent of any support provided, and the hours at which it is available.
INDEMNITY
You agree to indemnify and hold harmless Sigma Comics, LLC and its owners, subsidiaries, affiliates or other partners from any claim, demand, or investigation, including reasonable attorneys fees, made by any third party due to or arising out of Your Content, Your conduct , any alleged violation of these Terms, including any applicable Sigma Comics, LLC Policies, law, or regulation, or any alleged violation of any rights of another, including but not limited to Your use of any content, trademarks, service marks, trade names, copyrighted or patented material, or other intellectual property used in any dealings with Sigma Comics, LLC. Sigma Comics, LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by You, but doing so shall not excuse Your indemnity obligations.
RESALE OF DIGITAL AND PRINT CONTENT
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the content found within any products created by Sigma Comics, LLC.
LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT SIGMA COMICS, LLC AND ITS OWNERS, AFFILIATES, OR OTHER PARTNERS, SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES OR LEGAL THEORIES WHATSOEVER, FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF BUSINESS, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SIGMA COMICS, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: YOUR PURCHASES ON THIS WEBSITE; ERRORS, DEFECTS, OMISSIONS, DELAYS IN OPERATION OR ANY OTHER FAILURE OF PERFORMANCE; THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO, THROUGH, OR FROM YOUR PURCHASES ON THIS WEBSITE; UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (v) STATEMENTS OR CONDUCT OF ANY THIRD PARTY; (vi) ANY GOOD OR SERVICE OFFERED OR SOLD; OR (vii) ANY OTHER MATTER RELATING TO YOUR PURCHASES ON THIS WEBSITE. SIGMA COMICS, LLC LIABILITY TO YOU SHALL NOT, FOR ANY REASON, EXCEED THE AGGREGATE PAYMENTS ACTUALLY MADE BY YOU TO SIGMA COMICS, LLC. YOU ACKNOWLEDGE THAT SIGMA COMICS, LLC HAS SET ITS PRICES IN RELIANCE UPON THE LIMITATIONS OF LIABILITY AND THE DISCLAIMERS OF WARRANTIES AND DAMAGES SET FORTH HEREIN, AND THAT THE SAME FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES. YOU AGREE THAT THE LIMITATIONS AND EXCLUSIONS OF LIABILITY AND DISCLAIMERS SPECIFIED IN THESE TERMS WILL SURVIVE AND APPLY EVEN IF FOUND TO HAVE FAILED OF THEIR ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
SUBSCRIPTIONS
Sigma Comics offers several subscription options. With a Digital Subscription, once you pay for your subscription, you’ll get access to each one of your issues as they become available on your account on the Website. You will get an email notification telling you every time a new issue is released.
If you have a Print Reader Subscription, you get FREE SHIPPING so you pay only for your comic books, which are mailed to you poly-bagged and boarded in a standard envelope paper stock, through First-Class Mail from the USPS, as they are released! This is perfect for most readers, who aren’t concerned with their comic books being in pristine, ‘showroom’ condition. Your comics will arrive in your mailbox however they arrive; pristine, slight knicks ,dents, etc. Watch a video on how a Print Reader Subscription is shipped. Please note: Print Reader and Print Reader Combo Subscriptions cannot be canceled. This is because there are additional costs built into providing free shipping at this subscription level, which is why the Print Reader subscription level is much more affordable than a Print Collector Subscription. Note: Free shipping is limited to one (1) issue per domestic shipment.
If you have a Print Collector Subscription, you pay for both your comic books and shipping costs, which are mailed to you poly-bagged and boarded in a heavy-duty, literature box, through First-Class Mail from the USPS. This is perfect for collectors, who must ensure the highest value for their comic books and need them to arrive unblemished. Your comics will arrive in your mailbox in excellent condition. If on the extremely rare event that you receive a damaged issue, please alert us of a “Resend Request” at CONTACT and we’ll send you out another copy of that issue. Watch a video on how a Print Collector Subscription is shipped. Please note: you’ll be required to keep a valid credit card or debit card on file. Each time a shipment is ready, we will charge your credit card or debit card the corresponding shipping fee. Also note that there is a limit of two (2) Resend Requests per Print Collector or Print Collector Combo Subscription. This means you will only receive two replacements on your Print Collector or Print Collector Combo Subscription. Resend Requests are not available for Printer Reader or Print Reader Combo Subscriptions.
If you email us with a request to cancel your Print Reader Subscription, and we determine that the first issue of your subscription has yet to be sent to you, you’ll get a full refund! However, if an issue has already been sent out to you, we cannot cancel your subscription, and all 8 issues will continue to be mailed to your specified address.
Yes, you may cancel a Print Collector or Print Collector Combo Subscription at any time. Just alert us of a “Cancel Request” at CONTACT, and after we identify either your Print Collector or Print Collector Combo Subscription, we will issue a refund to your card on file. Please note: There is a $10 cancelation fee on all cancelations.
On average it takes 2-3 business days for you to receive your comic once we ship it.
If you have a digital or Reader subscription, you never pay for shipping, as it’s free! If you have any of the Collector subscriptions, you’ll be required to keep a valid credit card or debit card on file. Each time a shipment is ready, we will charge your credit card or debit card.
We DO NOT offer product returns; the reason being because we are currently not set up to handle a customer service operation. We just create comic books and send them out. That’s it. We’ll keep you posted when this changes.
Any time you buy a subscription, regardless of subscription level, you automatically receive access to the entire 8-issue series, so you never miss an issue!
SHIPMENTS
Each shipment you receive from Sigma Comics has a tracking number so you are always able to identify and track your package. If your comic is damaged and you have a Print Collector or Print Collector Combo Subscription, simply send us a “Resend Request” at CONTACT, and we’ll send you out a new copy of that issue at no cost. Please note there is a limit of two (2) Resend Requests per Print Collector or Print Collector Combo Subscription. This means you will only receive two replacements on your Print Collector or Print Collector Combo Subscription. Resend Requests are not available for Printer Reader or Print Reader Combo Subscriptions.
Sigma Comics ships internationally. However, international shipping does not qualify for free shipping.
SALES TAXES
Due to the 2018 Supreme Court case South Dakota v. Wayfair, we have to collect sales tax for all states that require it, which is most of them.
We are required by law to charge sales tax for all states except: Alabama, Alaska, Delaware, Florida, Idaho, Louisiana, Massachusetts, Mississippi, Missouri, Montana, New Hampshire, New Mexico, North Dakota, Oregon, Tennessee, Illinois, New York, and Oklahoma.
If you are a retailer or comic dealer who has a tax exempt reseller certificate from your state, you may provide us with a copy of your certificate and you will not be charged sales tax. Just select “Tax Exempt” at CONTACT, and indicate your status and possession of the documentation above and we will contact you for verification.
SMS Marketing
By consenting to Sigma Comics’ SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.
If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.

We have the right to modify any telephone number or short code we use to operate the service at any time. You will be notified on such occasions. You agree that any messages you send to a telephone number or short code we have changed, including any STOP or HELP requests, may not be received, and we will not be liable for honoring requests made in such messages.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
